By accessing or using the GradientPond platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms. If you do not agree to these Terms, do not use the Service.
GradientPond provides a machine learning platform including experiment tracking, distributed training, model registry, dataset versioning, and related tools and APIs. The Service is provided "as is" and we reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
You retain all rights to your data, models, code, and other content uploaded to the Service ("Your Content"). You grant GradientPond a limited license to host, store, and process Your Content solely to provide the Service. We will not access, use, or share Your Content except as necessary to provide the Service or as required by law.
You agree not to use the Service to:
Paid plans are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law. We may change pricing with 30 days notice. Failure to pay may result in suspension or termination of your account. Usage-based charges are billed in arrears based on actual consumption.
For paid plans, we commit to 99.9% uptime for the core platform services. Enterprise customers may negotiate custom SLAs. Service credits are available for downtime exceeding the SLA commitment. Scheduled maintenance windows are excluded from uptime calculations.
To the maximum extent permitted by law, GradientPond shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
Either party may terminate this agreement at any time. Upon termination, you may export Your Content for 30 days. After that period, we will delete Your Content in accordance with our data retention policy. We may terminate or suspend access immediately for violations of these Terms.
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the state or federal courts located in San Francisco County, California.
